Regulators and plaintiffs rarely need you to prove perfection — they look for whether you ran a reasonable program and responded when risk appeared. Build an “AI hiring evidence file” that can be produced quickly and tells a coherent story.
- What to log: your AI inventory, risk tiering decisions, notices used (with dates/screenshots), vendor documentation, testing plans/results, remediation actions, and approvals for model/feature changes.
- Operational audit trail: who reviewed AI outputs, when overrides occurred, and how exceptions were handled (including accommodations).
- Retention guidance: align with existing HR record retention and litigation hold practices; don’t create new “shadow” datasets unless you can secure and govern them.
Evidence strategies: keep versions (playbooks, prompts/configs, scoring rubrics), maintain meeting notes from your cross-functional review group, and document why a tool is job-related and consistent with business necessity. When testing finds adverse impact, record the investigation, root cause hypothesis, and the fix (or decision to disable the tool).
