Example: If you market “AI-verified compliance memos,” define “verified” in writing (what was checked, by whom, and against what sources). Then hardwire the workflow: the memo cannot be delivered until the verification checklist is completed and logged; marketing cannot use the phrase unless the firm can produce the verification packet for a sample set on request.

Data access + confidentiality: build a “data boundary” and provenance trail you can defend

“Confidentiality risk” isn’t abstract in AI workflows — it’s usually a data boundary failure: sending the wrong data to the wrong place, or being unable to prove what was (and wasn’t) accessed. Start by defining a boundary your firm can enforce consistently across matters and vendors.

Minimum viable provenance log (copy/paste fields): matter_id; user_id; model_provider; model_name; model_version; timestamp_utc; input_source_ids; prompt_hash; retrieved_doc_ids; corpus_version; toolchain_steps; reviewer_id; review_outcome.

Example (RAG over a DMS): To prevent cross-matter leakage, index per matter (or per client/matter), enforce retrieval filters at query time, and log retrieved_doc_ids + corpus_version for every answer. If a client later asks “did the model see Document X?,” you can answer with evidence — not assurances.

Court supervision + ethics: define when AI use must be disclosed and how to supervise it

Courts and ethics rules don’t care that an AI tool was “industry standard” — they care that lawyers remained competent, protected confidentiality, properly supervised staff/technology, and maintained candor to the tribunal.
