What AI Is (Not What Vendors Claim)
AI is pure mathematics. Statistical pattern recognition running on billions of learned examples.
This isn't marketing cynicism — it's the technical reality that determines everything about how AI works in legal practice.
What this means in practice:
- AI predicts statistically likely outputs based on training patterns—it doesn't "know" anything in a meaningful sense
- AI excels at pattern recognition tasks it's seen millions of times in training data
- AI fails predictably on novel situations, edge cases, and tasks requiring perfect accuracy
- AI has no concept of "truth"—only statistical likelihood
For legal work, this creates a fundamental tension: Law requires precision, accountability, and verification. AI provides plausible-sounding approximations with confidence that doesn't correlate to accuracy.
The Professional Responsibility Framework
Before diving into what AI can do, let's establish what the rules require you to do when using AI.
ABA Model Rule 1.1 and the Duty of Technological Competence
Comment 8 to Model Rule 1.1 requires lawyers to "keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology."
On July 29, 2024, the ABA issued Formal Opinion 512, providing the first comprehensive guidance on generative AI. The key holdings:

The Professional Ethics Committee for the State Bar of Texas issued Opinion 705 in February 2025, directly addressing generative AI ethics for Texas attorneys:
"Central to attorney obligations with respect to AI is the duty of competence outlined in Rule 1.01. Competence requires attorneys to understand how generative AI functions and to possess or acquire the necessary skill to use these tools effectively and ethically."
As the Texas Bar Blog emphasizes, lawyers must independently verify any information generated by AI before relying on it in client representation or court filings. Using AI-generated content without proper verification could expose attorneys to potential violations of rules related to fairness, honesty, and candor to the court.
The Non-Delegable Duty to Verify
Courts have been unequivocal: Attorneys have a non-delegable duty to personally read and verify every authority they cite—a duty that cannot be outsourced to law clerks, interns, paralegals, or technology.
This duty has been tested extensively through AI hallucination sanctions cases.
The Sanctions Cases: What Happens When You Don't Verify
The legal profession has learned about AI limitations the hard way—through a wave of sanctions that have fundamentally reshaped how attorneys must approach AI tools.
Mata v. Avianca: The Watershed Moment
Mata v. Avianca, Inc., 678 F.Supp.3d 443 (S.D.N.Y. 2023) stands as the defining case in AI legal ethics.
Judge P. Kevin Castel fined attorneys Steven Schwartz and Peter LoDuca $5,000 after they submitted a brief containing six fabricated cases generated by ChatGPT:

Why This Keeps Happening
The pattern is consistent across all these cases:
- AI generates plausible-sounding legal text that follows the patterns of legal writing it learned from training data
- The attorney assumes accuracy because the output looks professional and cites cases in proper Bluebook format
- The attorney fails to verify that the cases exist, are good law, or are applicable to the jurisdiction
- The court discovers fabrications when opposing counsel or the judge attempts to review the cited authorities
- Sanctions follow for violation of Rule 11 or equivalent professional responsibility rules
The problem: AI doesn't "know" it's lying. It's generating statistically likely text based on patterns. It has no internal sense of whether cases exist or citations are accurate.
What AI Can Do Reliably (and What It Can't)

High Reliability Tasks
What AI does well:
- Grammar and style checking — AI excels at identifying grammatical errors, awkward phrasing, and stylistic inconsistencies

Why these work: These tasks involve pattern recognition on common, well-represented structures in training data. They don't require novel reasoning, external knowledge, or absolute precision.
Medium Reliability Tasks — Use With Extensive Verification
What AI does inconsistently:
- Legal research summaries — Can identify relevant topics and provide overviews, but frequently mischaracterizes holdings or invents citations
- Contract clause generation — Produces plausible language but may include incorrect terms, inapplicable provisions, or conflicting clauses
- Deposition question lists — Generates reasonable starting points but lacks strategic context and case-specific nuance
- Email responses — Can draft routine communications but often misses tone, omits key details, or makes unsupported factual assertions
- Discovery categorization — Decent at high-level sorting but unreliable for privilege determinations or nuanced relevance calls
Why these are risky: These tasks require domain knowledge, legal judgment, or accuracy on specialized facts. AI has seen fewer examples in training data and must extrapolate from patterns rather than apply rules.
The danger zone: These outputs look professional and plausible, creating false confidence. Always verify before using.
Low Reliability Tasks — Don't Trust Without Complete Verification
What AI does poorly or dangerously:
- Case law citations — Legal AI tools hallucinate 17-34% of the time; general-purpose models like GPT-4 show 69-88% error rates on legal questions. Frequently fabricates cases, misattributes holdings, or cites overruled precedent

The pattern that works across successful AI implementations in law: AI handles sub-tasks while lawyers retain approval authority and final responsibility.
This is both a technical architecture and a professional responsibility requirement.
What "Lawyer-in-the-Loop" Means
The wrong approach (what gets lawyers sanctioned):
- Input prompt into AI
- Get output from AI
- Submit AI output directly to court/client/opposing counsel
The correct approach (what complies with professional responsibility):
- Input prompt into AI

Why Case Citations Are Especially Dangerous

The firms that succeed with AI don't start by asking "what AI tool should we buy?"
They start by asking:
- What workflows consume the most time?
- What tasks are repetitive and rule-based?
- Where do errors occur most frequently?
- What bottlenecks prevent scaling?
- What outcomes would meaningfully improve client service or firm economics?
Only after mapping current workflows and identifying improvement targets do they evaluate whether AI might help.
The Risk-Graded Implementation Approach
Don't start AI adoption with high-stakes work. Start with low-risk, high-volume tasks and prove governance before scaling.
Phase 1: Administrative Automation (Lowest Risk)

The Verification Checklist Approach
