Age Ratings and COPPA Compliance for Kids' Games: ESRB, IARC, and FTC Enforcement
Most game studios assume an ESRB or IARC rating handles their legal obligations to younger players. It does not. In January 2025, the FTC fined HoYoverse $20 million — not because the studio targeted children, but because its anime art style and influencer marketing made the game appeal to them. Age ratings classify content. COPPA compliance is a separate legal obligation with separate consequences.
Age Ratings 101: What ESRB and IARC Actually Do (and Don't Do)
Every game that ships through a major storefront carries some form of age rating. What developers often misunderstand is what that rating actually represents — and, more importantly, what it does not.
The Entertainment Software Rating Board (ESRB) is a voluntary industry self-regulatory body, not a government agency. Its ratings — E (Everyone), E10+, T (Teen), M (Mature), AO (Adults Only) — evaluate content suitability: violence, blood, language, sexual themes, gambling references, drug use. That's it. ESRB ratings carry no force of federal law and confer no legal protections under any federal privacy statute. The ESRB's own Privacy Certified blog makes this explicit, calling the assumption that an E or E10+ rating means a product is "directed to children" under COPPA "a fallacy." The content factors ESRB evaluates — violence, gore, language — are entirely separate from the audience factors the FTC evaluates when determining whether a game triggers COPPA obligations.
The rating tells players and parents what's in the game. Federal law asks something different: who is playing it, and what data are you collecting from them?
How ratings are actually issued. For physical retail releases, ESRB's Long Form process requires developers to complete a detailed content questionnaire and submit a DVD containing video footage of all pertinent gameplay — including the most extreme content. At least three trained ESRB raters review each submission. For studios with a development budget under $1 million submitting within 90 days of a digital rating, a value tier applies — but even that tier costs approximately $3,000. Physical distribution has a real price of entry.
Digital distribution follows a different path. The International Age Rating Coalition (IARC) provides free, automated ratings for games distributed through Google Play, the App Store, Nintendo eShop, the Microsoft Store, and the Epic Games Store. Developers complete a single questionnaire; IARC's algorithm generates regionally appropriate ratings simultaneously for all participating storefronts. As of 2026, the system has issued over 19 million ratings to more than 3 million developers worldwide. For most indie studios distributing digitally, IARC is the practical path — and the cost is zero.
One technical distinction matters here: for digital releases, ESRB staff do not individually review submissions. The ESRB rating on a digital title is generated by IARC's automated algorithm based on the developer's questionnaire answers. The developer's disclosure is the primary compliance input. That means accuracy is the developer's responsibility — and material inaccuracies in the questionnaire can create separate legal exposure.
What ratings don't do. An E rating does not mean your game is directed to children under COPPA. The ESRB's own examples make this concrete: travel apps, navigation tools, ride-sharing apps, sports news apps, retailer apps, card games, puzzle games, and flight simulators all commonly receive E or E10+ ratings. None of those categories would typically qualify as "directed to children" under the FTC's test. The content evaluation and the audience evaluation use entirely different criteria and serve entirely different regulatory purposes.
The practical consequence for developers: completing the IARC questionnaire and receiving an ESRB-equivalent rating does not satisfy, substitute for, or provide any evidence toward COPPA compliance. A studio that ships a colorful platformer with an E rating and no COPPA analysis has completed one obligation — content disclosure for storefront distribution — while leaving an entirely separate legal obligation unaddressed. The FTC's HoYoverse enforcement in January 2025, which resulted in a $20 million settlement, involved a game that was not marketed as a children's product and carried no E rating. The directed-to-children determination came from the FTC's independent audience analysis, not from any rating label.
Rating systems and COPPA operate on parallel tracks that never intersect. Studios need both analyses — and they are not interchangeable.
The COPPA “Directed to Children” Test Applied to Games
COPPA's obligations attach when an online service is "directed to children" — defined under 16 CFR § 312.2 not by what the developer intended, but by what the FTC finds when it applies a multi-factor test to the actual product. For game studios, understanding this test is not optional. It determines whether COPPA applies to your game at all, independent of how you labeled it, rated it, or marketed it.
The statutory factors. The FTC examines: subject matter; visual content; use of animated characters or child-oriented activities and incentives; music or other audio content; age of models; presence of child celebrities or celebrities who appeal to children; language; and advertising directed to children. The 2025 COPPA Rule amendments added four additional factors: marketing or promotional materials and plans; representations made to consumers or third parties; user and third-party reviews; and the age composition of users on similar websites or services. The FTC has emphasized that marketing materials "often provide compelling direct evidence" of intended audience — a recognition that what a developer says externally about its game is as relevant as what the game contains.
Genshin Impact as the controlling case. The January 2025 FTC settlement with Cognosphere/HoYoverse is the most important COPPA precedent for game developers in the post-2025 rule environment. The FTC's directed-to-children finding against Genshin Impact — a game rated T (Teen) by ESRB and never marketed explicitly to children — rested on a combination of design and marketing factors: anime-style cartoon graphics; bright, colorful animation; characters with the speech or appearance of children, including Paimon, a child-appearing mascot who serves as the player's guide throughout the game; fantasy combat with no blood or gore; and gameplay mechanics centered on exploration, role-playing, and hero collection. The FTC also cited HoYoverse's deliberate use of social media influencers popular with children on YouTube, TikTok, and Twitch, and spending millions of dollars on those campaigns.
No single factor triggered COPPA liability. The combination did — and that combination describes a significant portion of the anime-style RPG market.
The enforcement lesson is precise: if your game uses anime-style art, colorful and non-violent fantasy content, child-appearing characters, or a mascot character that appears childlike, and if your influencer marketing overlaps with youth-oriented creators, the FTC has now demonstrated it will reach a directed-to-children conclusion regardless of your ESRB rating or stated audience intent. Studios operating in this aesthetic space should treat HoYoverse not as an outlier but as a boundary-setting precedent.
The actual knowledge pathway. "Directed to children" is not the only entry point to COPPA liability. The statute creates a second, independent trigger: actual knowledge that a user under 13 is using the service. Under this pathway, a developer of a T-rated or M-rated game — one that would not meet the directed-to-children test on its own — becomes subject to COPPA the moment it gains actual knowledge that children under 13 are playing and that personal information is being collected from them.
The FTC construes "actual knowledge" broadly. Support tickets from parents, analytics dashboards showing users with birthdates indicating age under 13, age-entry fields where users self-identify as minors — all of these can constitute actual knowledge. The FTC's Xbox Live enforcement confirmed it will pursue COPPA claims against any company with actual knowledge of under-13 users, regardless of whether the service was designed for children. Studios that deliberately avoid age collection to maintain plausible deniability face an increasingly hostile enforcement environment under the 2025 rule's expanded marketing and review factors.
The mixed-audience path. The 2025 COPPA Rule formally codified a third category: the "mixed audience website or online service." An operator of a mixed-audience game — one that appeals to both children and adults — may collect personal information from its under-13 users provided it implements a neutral age-screening mechanism before any collection occurs and obtains verified parental consent for that segment. The FTC's examples of mixed-audience services include both Fortnite and Genshin Impact, which confirms that games with significant youth audiences can operate lawfully within the COPPA framework — but only with compliant age gating and segmented consent, not by claiming the game isn't "really" for children.
Platform Age Gating Requirements: Apple, Google, and Steam
Major game distribution platforms each impose their own requirements for games that reach or may reach children. Understanding those platform requirements matters — but so does understanding their limit. Platform compliance infrastructure manages distribution access. It does not satisfy the developer's independent COPPA obligations.
Google Play: the most prescriptive tier. Google's Families Policy imposes the strongest platform-level requirements on Android game developers. Any app that targets children — or targets both children and older audiences — must participate in the Designed for Families (DFF) program. DFF participation requires using only Google Play Families self-certified ad SDKs. Ad networks must self-certify COPPA compliance before they may serve ads in DFF apps. The policy also addresses identifier handling directly: apps that target both children and adults must ensure the Android Advertising ID (AAID) is transmitted only when it is confirmed that the user is not a child. Third-party SDKs not approved for child-directed services may not be implemented in ways that result in data collection from children.
In practice, DFF classification forces downstream SDK decisions. A game classified as Families cannot integrate a standard behavioral advertising SDK — the advertising SDK must itself be Google-certified for child-directed use. This restricts monetization options but also provides a structured compliance path: developers who follow DFF requirements have addressed Google's platform rules and constrained their SDK exposure under COPPA simultaneously.
Apple: moderate requirements, significant gaps. The App Store requires apps primarily intended for children under 13 to include a privacy policy, obtain parental permission or implement a parental gate before allowing external links or in-app purchases, and comply with COPPA. A 17+ App Store content rating effectively restricts younger users on supervised devices running Screen Time parental controls — but that restriction operates only where Screen Time is configured and enforced by a parent. Developers cannot rely on the 17+ rating as an independent COPPA defense for the users who reach the app despite parental controls.
Apple does not publicly disclose its developer agreement's exact COPPA compliance representation language, but secondary analysis of the App Store Review Guidelines confirms that COPPA compliance is a developer-side representation, not an Apple-side verification. Apple reviews apps for guideline compliance; it does not audit whether a developer's COPPA consent flow is legally sufficient.
Steam: minimal requirements, maximum developer exposure. Valve imposes the lightest compliance architecture of the major platforms. Steam's age gate for Mature or Adults Only content uses self-reported birth dates — players enter a birth year, and Steam does not verify it. Per the ESRB code of conduct, games with content warranting M or AO ratings must display an ESRB-compliant age gate before the store page or purchase becomes accessible. But Valve explicitly does not retain age information beyond a single browsing session, and no independent identity verification occurs. A thirteen-year-old who enters a false birth year reaches the game with no platform-level barrier.
Steam developer agreements require developers to represent that their games comply with applicable law. That representation includes COPPA where applicable. Valve provides the distribution channel; COPPA compliance is entirely the developer's problem. For indie studios releasing on Steam with any youth-appealing content, this means the developer bears undivided responsibility for any COPPA exposure — Steam's age gate provides no meaningful shield.
The through-line across all platforms. Platform developer agreements — Google, Apple, and Steam alike — require developers to represent compliance with applicable law, including COPPA. Platforms have designed their compliance infrastructure to manage their own exposure as distributors. That infrastructure constrains some developer choices (particularly on Android through DFF certification requirements) but does not discharge the developer's independent obligation to assess whether their game is directed to children, obtain verifiable parental consent where required, and operate a compliant data-collection regime for under-13 users. No platform's compliance framework substitutes for the developer's own COPPA analysis.
COPPA Compliance When Your Game Reaches Under-13 Players
Once a game is determined to be directed to children — or once a developer gains actual knowledge that under-13 players are using it — the COPPA compliance analysis becomes operational. Developers need to identify exactly what personal information their game collects, how consent must be obtained, and what monetization structures are compatible with the applicable consent method.
What constitutes personal information. Under 16 CFR § 312.2, personal information that triggers COPPA compliance obligations includes: names, physical addresses, online contact identifiers, screen names that function as contact information, telephone numbers, government-issued identifiers, persistent identifiers (cookies, IP addresses, device serial numbers, advertising IDs), photographs and audio or video containing a child's image or voice, geolocation data, and biometric identifiers. The 2025 rule amendments added biometric identifiers and government-issued IDs to this list explicitly.
The definition's breadth catches most standard analytics and advertising SDK deployments. Traditional analytics SDKs collect device advertising IDs (IDFA on iOS, GAID on Android), persistent user IDs, and IP addresses by default. Each of those data points qualifies as personal information under COPPA. This means that any game using an off-the-shelf analytics or advertising SDK — without auditing and restricting its collection behavior — is collecting personal information from the moment an under-13 player installs it. The audit step is not optional; it is the threshold determination for every downstream compliance decision.
The SDK audit decision tree. Start with a full inventory of every third-party library integrated into the game: analytics, attribution, crash reporting, advertising, chat, push notifications, A/B testing. For each SDK, document what data it collects by default and map those data points to COPPA's personal-information definition. If the SDK collects persistent identifiers from all users regardless of age, it must be replaced with a COPPA-certified alternative, disabled for under-13 users, or implemented behind a neutral age screen that prevents under-13 users from reaching it. Developers using behavioral advertising SDKs should treat the answer as categorical: behavioral advertising to under-13 users is effectively prohibited under the 2025 COPPA framework because the persistent identifiers required to serve behavioral ads constitute personal information, and the separate-consent requirement makes obtaining compliant consent for behavioral advertising commercially unworkable in most game contexts.
Consent method selection. The 2025 COPPA Rule recognizes several methods for obtaining verifiable parental consent (VPC): email-plus, knowledge-based authentication (KBA), text-plus, and government ID facial recognition with prompt deletion. The choice of consent method has direct consequences for what the game can and cannot do.
Email-plus is often presented as the low-cost option. It is — but it comes with a critical restriction: if a developer uses email-plus, the game cannot use any third-party APIs, including ad networks, analytics platforms, crash reporting tools, social networking features, or leaderboards. Email-plus verification does not result in verifiable parental identification (any adult can provide an email address), and the FTC treats it as valid only for services that share no personal information with third parties. For any game with analytics integration, advertising, or social features, email-plus is incompatible with the SDK stack by definition.
Knowledge-based authentication — dynamic multiple-choice questions designed to have low guessability rates that a 12-year-old is unlikely to answer correctly — is the more appropriate choice for games that need third-party SDK access. Text-plus (SMS consent confirmed via follow-up text, letter, or phone call) is also recognized. Government ID facial recognition is available but operationally demanding and typically appropriate only for higher-risk consent scenarios. For most indie studios, KBA through a specialized consent vendor (PRIVO, AgeCheq, and similar services) or text-plus are the practical options for games with any third-party data integration.
The April 22, 2026 deadline. The 2025 COPPA Rule amendments require separate verifiable parental consent before a child's personal information may be disclosed to third parties for targeted advertising or AI model training. A single bundled consent checkbox covering all data uses is no longer compliant as of April 22, 2026. Studios that currently use a bundled consent form — or that have not yet built any consent flow — have a concrete deadline. Consent forms need to allow parents to consent to core data collection without consenting to advertising disclosure, and to consent to advertising disclosure separately. Any game reaching under-13 users that is not compliant by April 22, 2026 is operating in violation of the amended rule.
COPPA Enforcement in Gaming: The Cases That Define the Risk
Abstract compliance requirements become concrete when mapped against the FTC's actual enforcement record. Four cases define the current risk landscape for game developers — and they show a consistent escalation in both penalty size and the breadth of conduct the FTC treats as COPPA violations.
Musical.ly ($5.7 million, February 2019). The enforcement trajectory begins with Musical.ly, the music-and-video sharing app that later became TikTok. The FTC found that Musical.ly collected names, email addresses, phone numbers, birthdays, profile photos, and geolocation data from users who self-identified as under 13 — then failed to notify parents or obtain verifiable consent. The settlement required deletion of personal information collected from children and imposed ongoing compliance obligations. At $5.7 million, it was the then-record COPPA fine, and it established a foundational principle that remains controlling: collecting basic account-registration data from self-identified child users without parental consent is sufficient for liability. Any game requiring account creation — username, email, birth date — faces the same exposure if under-13 users provide that information without a compliant consent process in place.
YouTube ($170 million, September 2019). The Google/YouTube settlement displaced Musical.ly's record within the same year. YouTube hosted child-directed channels, touted its popularity with children to advertisers, and simultaneously ran behavioral advertising on those channels — tracking viewer cookies and IP addresses for targeting purposes. The FTC and New York Attorney General found that YouTube earned approximately $50 million from this practice. The settlement required Google and YouTube to pay $170 million combined and to develop a system allowing channel owners to identify child-directed content for COPPA treatment. The enforcement pattern is directly applicable to games with embedded advertising: running behavioral ad SDKs on content that the platform knows is reaching children creates liability under COPPA regardless of whether the content was officially labeled as child-directed.
Epic Games ($275 million COPPA penalty, December 2022). The Epic settlement remains the largest COPPA penalty in FTC history. The FTC's allegations were multifaceted. Epic collected personal information from children playing Fortnite without parental notification or verifiable consent. Fortnite enabled real-time voice and text chat between children and strangers by default — a design decision that created COPPA exposure independently of any analytics SDK. When parents requested data deletion, Epic required excessive verification: IP addresses, account creation dates, purchase invoices, and in some cases passport copies. The design-level lessons from Epic extend beyond analytics: default-on voice and chat features for users of any age create COPPA exposure if children are in the user base. Deletion request processes that are deliberately burdensome create independent liability. The FTC's Fortnite directed-to-children finding rested on cartoon graphics, build-and-create mechanics resembling fort construction, extensive toy and merchandise licensing, and celebrity partnerships popular with minors — a design profile that describes a wide swath of the action and survival game market.
HoYoverse/Cognosphere ($20 million, January 2025). The Genshin Impact settlement is the controlling precedent for the post-2025 enforcement environment. Unlike Musical.ly or Epic, Genshin Impact was not a service obviously designed for children — it carried a T (Teen) ESRB rating and was positioned as a premium RPG for general audiences. The FTC nonetheless found it directed to children based on anime-style graphics, colorful animation, child-appearing characters including the mascot Paimon, no-blood-or-gore fantasy combat, and HoYoverse's deliberate use of youth-popular influencers on YouTube, TikTok, and Twitch. The liability mechanism was standard analytics SDK data sharing: HoYoverse shared device-related persistent identifiers and player engagement records with third-party analytics and advertising providers without the parental consent required by COPPA.
The common thread across all four cases is precise: analytics SDKs collecting persistent identifiers, combined with knowledge — actual or constructive — that children are in the user base, plus the absence of a compliant consent flow, equals COPPA liability. The penalty trajectory from $5.7 million to $275 million over six years indicates the FTC is not treating this as a compliance formality. For indie studios operating in any genre with visual or marketing appeal to younger audiences, these cases are the floor of what non-compliance costs — not the ceiling.
Building a COPPA-Compliant Kids’ Game: Technical and Legal Requirements
COPPA compliance for a game reaching under-13 users requires decisions made at the architecture level — not as an afterthought after launch. The following four-step protocol addresses the core technical and legal requirements in the order a development team should address them.
Step 1: SDK audit before launch. Before any under-13 user touches the game, conduct a complete inventory of every third-party SDK integrated into the build. The inventory must cover: analytics, attribution, crash reporting, advertising networks, chat or messaging systems, push notification providers, A/B testing platforms, and any other library that touches user data. For each SDK, document what personal information it collects by default — specifically whether it collects device advertising IDs (IDFA/GAID), persistent user IDs, IP addresses, precise geolocation, audio or biometric data, or cross-app behavioral tracking data. Every item on that list is personal information under COPPA if collected from a child under 13.
Replace behavioral advertising SDKs with COPPA-certified contextual alternatives that do not collect persistent identifiers. Disable non-essential identifier collection in analytics platforms — contextual analytics that collect only event names, session IDs, timestamps, platform type, and country-level location are COPPA-safe. Any SDK that cannot be configured to eliminate personal-information collection from child users should be removed before the game reaches an audience that includes under-13 players. The Epic settlement is the negative example: default-on voice chat and failure to honor deletion requests were gaps in the design-level SDK and feature architecture, not failures of legal review alone.
Step 2: Implement a neutral age gate. The 2025 COPPA Rule requires age-screening mechanisms to operate "in a neutral manner that does not default to a set age or encourage visitors to falsify age information." This means: no pre-populated birth year that defaults to an adult age, no interface design that visually steers users toward selecting an adult birth date, and no retry-and-succeed flow that allows a user who enters an under-13 birth date to simply re-enter the form with a different answer. When a user enters a birth date establishing they are under 13, the gate must either block data collection entirely, route to a parental consent flow, or provide a limited non-data-collecting experience. A gate that fails these requirements provides no legal protection — it is a design element, not a compliance mechanism.
Step 3: Select a consent method compatible with the SDK stack. The consent method decision follows directly from the SDK audit. If any third-party SDK remains in the build that collects personal information from users, email-plus is not an available option. Email-plus verification prohibits the use of third-party APIs including ad networks, analytics platforms, crash reporting tools, social networking features, and leaderboards. For games with any of those integrations, knowledge-based authentication (KBA) or text-plus are the appropriate methods. KBA presents dynamic multiple-choice questions designed for low guessability by children — specialized consent vendors including PRIVO and similar services implement this infrastructure as a service. For studios operating a pure local-data game with no third-party integrations, email-plus remains valid but limits future monetization options significantly.
Step 4: Build a data retention and deletion pipeline. COPPA requires that personal information collected from children be retained only as long as necessary to fulfill the purpose for which it was collected, then deleted using reasonable measures. That obligation must be operationalized, not just stated in a privacy policy. Define specific retention periods for each category of data the game collects. Build automated deletion processes for those periods. Implement a parent-facing deletion request mechanism that is straightforward to use — the Epic settlement's documented practice of requiring IP addresses, purchase invoices, and passport copies as prerequisites for deletion is the enforcement blueprint for what not to do. Segment user data by age group so that under-13 data can be isolated, separately managed, and deleted independently of adult user data.
Analytics collection beyond what the game mechanic requires is the most common point where indie developers accumulate COPPA exposure without recognizing it. Virtual economy systems — currencies, marketplaces, inventory — create additional data collection points that need explicit COPPA mapping. Social features including leaderboards, friends lists, and real-time voice or text communication between players create exposure independently of the analytics SDK stack. Each feature category requires its own analysis, not a single blanket privacy policy representation.
Compliance Checklist and Safe Harbor Programs
April 22, 2026 is the compliance deadline for the 2025 COPPA Rule amendments. Studios that have not completed their COPPA framework by that date are operating in violation of the amended rule — not a prior version of it. The following checklist and safe harbor overview are structured around that deadline as the actionable anchor.
Ten-item COPPA compliance checklist for game studios:
- Run the directed-to-children self-assessment. Apply all factors under 16 CFR § 312.2 — including the 2025 additions (marketing materials, third-party representations, user reviews, comparable audience composition) — to your game and its marketing ecosystem. Document the analysis and its conclusion.
- Conduct the full SDK audit. Inventory every third-party library, document what personal information each collects by default, and map each data point to COPPA's definition. This is the threshold document for all downstream decisions.
- Replace or disable non-compliant SDKs. Swap behavioral advertising SDKs for COPPA-certified contextual alternatives. Restrict analytics platforms to collecting only non-personal contextual data from under-13 users.
- Implement a neutral age gate. Design the gate to the 2025 rule's neutral-manner standard: no default adult ages, no UI patterns encouraging age falsification, no retry-and-succeed flows. Confirm the gate triggers the correct downstream flow for under-13 entries.
- Select a consent method compatible with the SDK stack. If any third-party API remains, email-plus is disqualified. Use KBA, text-plus, or a government ID method appropriate to the game's user base and feature set.
- Redesign bundled consent forms. The April 22, 2026 deadline requires separate parental consent for disclosure to third parties for targeted advertising or AI training. A single checkbox covering all data uses is no longer sufficient.
- Draft a children's-specific privacy notice. The notice must describe, at the data-point level, what information the game collects from children, how it is used, and how parents can review, delete, or withdraw consent.
- Establish a documented data retention and deletion policy. Define specific retention periods for each category of children's data. Build automated deletion pipelines. Implement a parent-facing deletion request mechanism that imposes no unreasonable verification burdens.
- Verify platform developer agreement compliance. Confirm the game meets Google DFF program requirements if distributed on Android, Apple parental gate requirements if distributed on iOS, and any platform-specific data disclosure obligations.
- Build an annual COPPA review into the compliance calendar. COPPA obligations are not a one-time deliverable. Regulatory guidance evolves, SDKs update their collection behavior without notice, and game features change. A standing annual review prevents compliance drift.
Safe harbor programs: what they provide and what they don't.
The FTC has approved several COPPA Safe Harbor programs: ESRB Privacy Certified, kidSAFE Seal Program, PRIVO, iKeepSafe, and CARU (a BBB National Programs division). Safe harbor membership means the FTC defers to the program's own investigation and enforcement mechanisms before pursuing direct federal enforcement against a member operator. For game studios, ESRB Privacy Certified is the most directly relevant option — it is specifically designed for video game and toy-related online products and services and is already familiar to studios engaged in the ESRB content rating process. kidSAFE skews toward educational and younger-audience products. PRIVO and similar vendors also operate as verifiable parental consent implementation providers, not only as safe harbor administrators.
Safe harbor membership provides compliance reviews (at least twice annually for most programs), spot audits, access to guidance on federal and state privacy law updates, and a seal that communicates compliance status to users and distributors. The 2025 rule amendments also required approved safe harbor programs to publish public member lists by July 21, 2025, and to submit annual reports to the FTC starting October 22, 2025 — meaning the programs themselves are now subject to heightened FTC oversight.
One limitation deserves explicit treatment: safe harbor membership is not immunity from FTC enforcement.
